This Acceptable Use Policy ("Policy") sets the rules for everyone who uses Phonetico, whether as a contributor, as a developer or customer of our API, or as a visitor. It forms part of the Terms of Service and the Developer Terms, which define "Phonetico," "we," "us," and "our," and it changes as they do. In this Policy, the "Services" means the contributor Platform, the App, and the Developer Services those documents describe.
Speech technology can be misused to deceive and to harm. This Policy exists to prevent that. Breaking it is a breach of your agreement with us and can lead to the consequences in Section 8.
1. General
You must not use Phonetico to do anything unlawful, to infringe anyone's rights, or to harm others. You must comply with the laws that apply to you and to the people whose voices or data are involved.
2. Voice, identity, and synthetic audio
You must not:
- clone, imitate, or synthesize the voice of a real person, whether a public figure or a private individual, without that person's explicit, documented consent;
- use synthesized or cloned audio to impersonate a person or an organization, or to make it appear that someone said something they did not say;
- use the Services to commit fraud or a scam, including voice phishing, fake customer-service or authority calls, or circumventing voice-based security;
- create sexual content depicting a real person without consent, or any sexual content involving a minor; or
- submit, as a contributor, synthetic, generated, pre-recorded, or manipulated audio as if it were your own live voice.
3. Integrity of contributions and the data we build
You must not:
- submit fraudulent, padded, duplicated, or deliberately low-quality work;
- submit a recording of another person's voice without that person's documented consent;
- use automation to generate or submit contributions where a task calls for a real person; or
- interfere with, defeat, or work around our quality, review, or fraud controls.
4. Conduct toward other people
In recorded conversations and anywhere people interact on the Platform, you must not:
- harass, threaten, demean, or sexually solicit another person;
- share sexual, hateful, or unlawful content;
- record a person who has not received notice of the recording and consented to it;
- impersonate another person, or play back recorded, synthetic, or generated audio as if it were your live voice; or
- try to exchange contact details with another participant, or move them off the Platform, to evade its safeguards.
5. The Services, security, and others' systems
You must not:
- copy, modify, or reverse engineer the Services or any model, or try to discover a model's weights, architecture, or training data;
- build, train, or improve a product that competes with the Services from any part of them or from their outputs, including by distilling a model from outputs;
- scrape, resell, or redistribute the Services except as part of your own application as the Developer Terms allow;
- exceed, evade, or work around a published rate limit, usage limit, or spend cap, or a quality, safety, or fraud control;
- probe, scan, or breach the security of the Services, access an account or data that is not yours, or interfere with other users; or
- introduce malware, or use the Services to deliver it.
6. Others' data and privacy
You must not send us, upload, or process data about other people that you do not have the right to send or process, including voice recordings made without the speaker's informed consent. If you use the API to process personal data of others, the Developer Data Processing Terms apply, and you are responsible for the lawfulness of that data.
7. Prohibited and high-risk uses
You must not use the Services to produce or support content or activity that is illegal where it has effect, that incites violence or self-harm, that targets people for abuse, that spreads deliberate disinformation designed to deceive, or that otherwise creates a serious risk of harm. We may decline specific uses that carry a high risk of harm even where they are not expressly listed here.
8. Enforcement
We may investigate suspected breaches of this Policy. What we do depends on what we find. We may reasonably remove content, refuse or reverse a transaction, withhold or reclaim payment as the Terms of Service and the Transcriber Agreement provide, limit, suspend, or revoke an API key, suspend or close an account, and report conduct to the authorities. Where a breach creates an immediate risk to people or to the Services, we may act first and explain afterward. We will give notice and a chance to respond where it is reasonable to do so.
9. Reporting
To report a breach of this Policy, misuse of a voice, or abusive conduct, email [email protected]. To report a security issue, email [email protected]. We do not retaliate against anyone who reports a concern in good faith.
